Mechanical ventilation system design and installation
Steel and HVAC duct fabrication

Annual maintenance contracts
Supply of fans, cooling systems, and HVAC components
You may use our website for lawful purposes only, including:

Requesting quotes and consultations

You agree not to:

Attempt to gain unauthorized access to our systems

All quotations provided are:
Valid for 30 days from the date of issue unless otherwise stated
Subject to site inspection and final measurements
Exclusive of taxes unless explicitly stated
Based on the specifications provided by the client
Service contracts become binding when:
Both parties have signed the agreement
Initial payment (if required) has been received
Project scope and timeline have been confirmed
Any changes to the agreed project scope must be:
Requested in writing
Assessed for cost and timeline implications
Approved by both parties before implementation
Standard payment terms will be specified in individual service contracts
Typical payment structure: deposit upon contract signing, progress payments, and final payment upon completion
Annual maintenance contracts are payable in advance or as specified in the agreement
Late payments may incur interest charges as specified in the service contract
Vivid Air reserves the right to suspend services for overdue accounts
Persistent non-payment may result in contract termination
All prices are in Sri Lankan Rupees (LKR) unless otherwise stated
Prices are subject to change without notice for future projects
Existing contracts will honor agreed-upon pricing
Project timelines are estimates and may be subject to change due to unforeseen circumstances
Delays caused by client, third parties, or force majeure events will not be the responsibility of Vivid Air
We will make reasonable efforts to notify clients of any anticipated delays
Clients must ensure:
Safe and unobstructed access to work areas
Availability of necessary utilities (electricity, water)
Compliance with health and safety requirements
Removal of any obstacles that may hinder installation
Provide accurate site information and measurements
Obtain necessary permits and approvals
Ensure site readiness as per agreed schedule
Designate a point of contact for project coordination
Products supplied come with manufacturer warranties as specified
Warranty terms vary by product and will be communicated at time of purchase
Warranty claims must be submitted with proof of purchase
Installation work is warranted against defects in workmanship for a period specified in the service contract
Warranty does not cover damage caused by misuse, neglect, or unauthorized modifications
Regular maintenance as per our recommendations is required to maintain warranty validity
Warranties do not cover:
Normal wear and tear
Damage from accidents, misuse, or negligence
Modifications or repairs by unauthorized parties
Failure to follow maintenance guidelines
Force majeure events
Annual maintenance contracts include:
Scheduled preventive maintenance visits
System inspections and performance checks
Cleaning and filter replacements as needed
Priority response for service calls
Detailed service reports
Unless specifically included, annual contracts do not cover:
Major repairs or component replacements
Upgrades or system modifications
Emergency callouts outside business hours (may incur additional charges)
Damage from external factors
Contracts are subject to annual renewal
Pricing may be adjusted at renewal based on current rates
Notice of non-renewal must be provided 30 days before contract expiration
To the fullest extent permitted by law:
Vivid Air's total liability for any claim shall not exceed the amount paid for the specific service in question
We are not liable for indirect, consequential, or incidental damages
We are not liable for delays or failures due to circumstances beyond our reasonable control
Our liability does not extend to third-party products or services
All content on our website, including text, graphics, logos, and images, is the property of Vivid Air or our licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
Both parties agree to maintain confidentiality of:
Proprietary business information
Technical specifications and designs
Pricing information
Client data and project details
Confidentiality obligations survive termination of any service agreement.
We may terminate services if:
Client breaches these Terms or service agreements
Payment obligations are not met
Client conduct endangers our staff or reputation
Continuing service becomes commercially impractical
Clients may terminate services by:
Providing written notice as specified in the service contract
Paying applicable cancellation fees
Settling all outstanding payments
We encourage clients to contact us directly to resolve any disputes or concerns.
If informal resolution is unsuccessful, parties agree to attempt mediation before pursuing legal action.
These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in Colombo, Sri Lanka.
Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to:
Natural disasters
Acts of government or war
Strikes or labor disputes
Pandemics or health emergencies
Supply chain disruptions
You agree to indemnify and hold Vivid Air harmless from any claims, damages, or expenses arising from:
Your breach of these Terms
Your use of our services
Violation of any laws or third-party rights
Inaccurate information provided to us
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
These Terms, together with any service contracts and our Privacy Policy, constitute the entire agreement between you and Vivid Air regarding the use of our services.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.
